Acceptance
By using YAYA Uptime ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
Monitoring Authorization
You confirm that you have authority to monitor any domain, storefront, or URL you add to the Service. You represent that you own or have sufficient rights to authorize automated monitoring of those properties. You are responsible for ensuring that your use of the Service complies with applicable terms of service of any third-party platforms (e.g., Shopify, WooCommerce) and with applicable law.
Service Description
The Service provides visual monitoring and checkout testing for ecommerce storefronts, including uptime monitoring, visual regression detection, and related features. We reserve the right to modify, suspend, or discontinue features at any time. We will use reasonable efforts to notify you of material changes.
Account and Billing
You must provide accurate account information and keep it current. You are responsible for maintaining the security of your credentials. Billing is handled according to your selected plan. Fees are non-refundable except as required by law or expressly stated in our refund policy.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YAYA UPTIME AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify and hold harmless YAYA Uptime and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
